Hospital found liable for $4.25 million in birth lawsuit

SEATTLE — Evergreen Hospital in Kirkland has been ordered to pay $4.25 million for a troubled birth that left a girl with severe brain damage.

Hospital officials say'll appeal the King County Superior Court jury award to Erik and Sharla Tavares and their 5-year-old daughter, Miriam Tavares. She has cerebral palsy and severe brain damage.

According to the Tavarases, the mother arrived at the hospital with contractions a day before she was scheduled for a Caesarian section. They say nurses failed to notify an obstetrician that a high-risk patient had arrived, so the doctor went home for dinner, and they blame the delay in his return for their daughter's severe problems.

Hospital officials say the baby's injuries occurred before the mother arrived at the hospital.

" Apparently the family had alot of evidence to prove that they aren't "just sue happy people". If it were your child what would you do Common Sense 24? It's okay for this family to have wrong health care I think not. "

" A very sad situation but hard to judge. I went into labor at 11 pm on a Sunday night the day before a planned Caesarian for a risky birth. Less than four hours later my very healthy son was delivered at Cowlitz Hospital with four MDs present. I will always be grateful for the caring and skillful medical care we received that night. "
