Olympia lawyer argues people don't have to show ID on demand

TACOMA — Olympia lawyer Lagrand Jones says it’s not a crime to refuse to provide identification to police.

That’s why he pleaded not guilty Wednesday in Tacoma Municipal Court to charges of trespassing and obstructing a police officer.

Jones was arrested last week during an anti-war demonstration at the Port of Tacoma where a ship was unloading Fort Lewis equipment returning from the Iraq war.

He’s accused of approaching a fence on port property July 30 and refusing to give an officer his ID.

Jones told the Tacoma News Tribune, “I don’t have to show my papers on demand. I don’t live in that kind of world.”

The judge refused a motion to dismiss the charge, and the case will continue to trial.

" Bert: If you are refering to the 1st Amendment of the US Constitution the people do have a right to peacefully assemble. I would argue that breaking the law by trespassing on gov't property doesn't really qualify as a peaceful assembly. Also, if he was assembled there to forward his cause would't he want the gov't to know who he is and what he is for? Why try to hide your identity? "

" The article is not clear as to whether or not he was on port property. It says that he was "approaching a fence on port property". If we have become a police state, it is our own fault since we are doing nothing to stop it. For example demanding that when a police officer shoots someone in the line of duty, that the shooting be investigated by a civilian panel choosen for the purpose and not by the police themselves. This is like asking a cat to guard the mouse! The gun has become a defense rather than karate in too many cases.
In a democracy it is the people who are supposed to see that things are kept on the up and up. Americans for the most part are too lazy and fail to do what they should do. Ten million letters to Congress demanding a law making it a felony for a congressman to accept campaign funds over $250 per individual or company would get the law changed. It is a pity that most Americans suffer from writeitis (the inability to write a letter). We are in the Iraq war because Americans refused to stand up to Bush and his cronies, did nothing about impeaching him. Was Saddam an evil man, probably yes, but you can say that about many members of the congress (Foley, Craig etc.) America needs to clean up its own act before "advising" what other countries should do. " I am 50 + years old. Almost all the males in my family have served in the military (exception: brother died when he was 11). Not ONE of them would advocate having to produce I.D. on demand except in instances where I.D. had been issued. I have a drivers license that I am only forced to produce when I am driving a car and being stopped by a police officer and I have my company I.D. that I must be able to show should a customer ask. This country (the U.S.A.) does NOT have a national I.D. card that we are mandated to show anytime a person in the government or law enforcement ask to see it! We are violating the law if we mis-identify ourselves (and they discover it) when asked by law enforcement, but we are NOT required to carry and show I.D. at all times. "

I work in the criminal justice system and have seen incidents of abuse of power from law enforcement. Not from the majority, but more than most people would suspect. no one should be forced to show id unless there is probable cause for an arrest in which case it shall be left to the courts to identify the person.

Just let me point out that in the article, the man was not arrested for CROSSING the fence, he was arrested for APPROACHING the fence... If the fence is the boundary and he didn't cross it, how was he trespassing? Not everyone agrees with the war, and peaceful protest is healthy.
